Terms of Service
These Terms of Service govern your use of Kevaly, an AI lifestyle photo generation app. By creating an account, uploading photos, buying credits, subscribing, or using the app, you agree to these Terms.
What Kevaly Does
Kevaly lets you upload or capture selfies and choose style settings to request AI-generated lifestyle photos. Generated photos are synthetic AI outputs and may contain errors, artifacts, inaccuracies, or unexpected changes.
No Guarantee Of Results
- Kevaly does not guarantee that any generated photo will look like you, match your expectations, be realistic, be error-free, or be suitable for any specific purpose.
- Results may vary based on selfie quality, lighting, pose, selected settings, provider availability, and AI model behavior.
- You are responsible for reviewing generated photos before saving, sharing, publishing, or relying on them.
Your Responsibilities
- Only upload photos of yourself or photos that you have permission and legal rights to use.
- Do not upload photos of children, private individuals without permission, celebrities, public figures, or anyone you are not authorized to represent.
- Do not use Kevaly to impersonate others, mislead people, create deceptive identity documents, commit fraud, harass others, or violate law or third-party rights.
- You are responsible for how you use, publish, caption, distribute, or monetize generated photos.
AI Content Disclosure
Photos generated by Kevaly are AI-generated. You should not present generated photos as documentary proof of real events, real travel, professional credentials, medical or legal facts, identity verification, or other high-stakes claims.
Credits, Subscriptions, And Purchases
- Photo credits are used to request generations. Credit costs may vary by selected feature, quality, or image size.
- Subscriptions renew automatically unless canceled through your App Store account before renewal, according to Apple’s rules.
- In-app purchases and refunds are handled by Apple. Kevaly does not control Apple billing decisions, refund eligibility, processing times, or payment methods.
- Credits, subscription benefits, pricing, and promotional rewards may change over time where permitted by law.
Availability And Service Changes
Kevaly may be unavailable, delayed, interrupted, or degraded due to maintenance, network issues, third-party providers, AI provider limits, app store systems, or other causes. We may change, suspend, or discontinue features at any time where permitted by law.
Ownership And License
You retain rights you already have in photos you upload. By uploading photos and choosing generation settings, you grant Kevaly and its service providers a limited license to process that content to provide, secure, troubleshoot, and support the service.
Privacy
Kevaly’s handling of personal information is described in the Privacy Policy. Selected selfies and generation instructions may be sent to third-party AI providers only to complete the generation you request.
Account Suspension And Termination
We may restrict, suspend, or terminate access if we believe you violated these Terms, created risk for Kevaly or others, abused the service, attempted fraud, or used the app in an unlawful or harmful way.
Disclaimers
To the maximum extent permitted by law, Kevaly is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, non-infringement, or uninterrupted operation.
Limitation Of Liability
To the maximum extent permitted by law, Kevaly and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, reputational harm, business interruption, or damages arising from your use of generated photos. Our total liability for claims related to the service will not exceed the amount you paid to Kevaly through the app in the 12 months before the claim, or USD $50, whichever is greater, unless applicable law requires otherwise.
Changes To These Terms
We may update these Terms from time to time. If changes are material, we may notify you in the app or by other reasonable means. Continued use of Kevaly after changes become effective means you accept the updated Terms where permitted by law.
